Adult Shop Laws "Miss The Mark"
The industry body representing Queensland adult shops says a proposal to ban new sex shops from opening within 200m of schools and churches misses the mark.

Deputy premier Paul Lucas said the government hoped to have draft planning regulations to stop new adult shops opening near “sensitive uses” drawn up by March.

Mr Lucas said adult stores were legitimate businesses, but he understood why parents would not want one in a school environment. But Eros Association chief Fiona Patten said the law was meaningless without improved censorship.

Ms Patten said Queensland needed to follow other states and regulate legal adult material rather than ban it.

She said children could legally enter adult shops, because under Queensland law, there were no restricted products in them.

“What is the point in making sure adult shops are 200 metres from schools when school children can legally enter the premises?” Ms Patten said.

Mr Lucas stood by Queensland’s stance on adult material, saying it was “the toughest in Australia”.

A Sunshine Coast Regional Council spokeswoman said applications for adult shops on the Sunshine Coast were still considered using guidelines set out by the former Maroochy, Noosa and Caloundra councils.

She said there were no special requirements that applicants wanting to start adult shops in the old Noosa shire needed to meet.

People wanting to start shops in the Maroochy and Caloundra shires needed to advertise and give people an opportunity make submissions which needed to be handed to the council, she said.

"Planners believe the new proposed regulation will impact on the way they assess such applications under the current three planning schemes," the spokeswoman said.

"However, to what extent is still to be considered.

She said work towards a regional planning scheme was already underway and a draft could be expected this year.

An adult shop in Caloundra's main street remained open in October while the council processed its business application despite the business's location being in violation of the town plan.

The Totally Adult shop at the top of Bulcock Street opened its doors despite the main street being zoned as a district business centre which was a classification that did not allow adult operations.
