Mr. Jeff Oliver from Flirt Adult Stores said today: That the new Flirt Adult Store proposed for Lithgow is still in limbo even though the Land and Environment Court of NSW had upheld his appeal.
Mr. Oliver went on to say: Lithgow Council has refused to provide a construction certificate for the development; this is a clear indication that council is positioning itself to appeal the courts decision he said.
Grounds to appeal are very limited however Lithgow Council obviously feels confident in the outcome, considering they are prepared to commit even more money, which so far would be in excess of $100,000. It’s also important to note that this type of appeal has significant financial impact where the court can award costs against the unsuccessful party. He also said that by appealing the decision sends a clear message that a new business and new jobs are not welcome in this community. He said
I don’t understand why this council is so determined to stop this business considering it would be a new business in the community. It will contribute to the economy of the community by employing locals, buying local and providing other products not yet available locally. Surly Lithgow needs more jobs and more business investment?
Lithgow locals have to travel to Bathurst to shop for adult products, this supports the Bathurst economy and not Lithgow, surely we should be encouraging them to shop local and contribute to the local economy.
It just doesn’t make sense. Mr. Oliver concluded.
