Mr. Jeff Oliver from Flirt Adult Stores said today: The victory he had in the Land and Environment Court of NSW has been short lived after Lithgow Council resolved to seek advice from a Barrister to appeal the ruling in the Supreme Court of NSW.
Mr. Oliver went on to say: That at the council meeting on the 7th may 2007, a local business owner and member of the Exclusive Brethrens Religious Sect had offered up the business community to fund the cost of a barrister to access the likelihood of an appeal and potentially fund the appeal process.
The Lithgow Council, General Manager has agreed to negotiate a deal on behalf of council.
Mr. Oliver said that he had contacted the Lithgow Business Association who were unaware of the offer. He also said: I'm sure that the business community will be horrified to find out that have been misrepresented and now they are expected to put there hands in there pocket to fund Lithgow Councils legal challenge.
Mr. Oliver also said, that he has been made aware that no adult store development application has ever gone to the Supreme Court of NSW, Its simply unheard, off he said.
Mr. Oliver said that the Exclusive Brethrens Religious Sect was the only religious group represented at the meeting.
Lithgow Council now has until the 20 may 2007 to lodge an appeal and Mr.Oliver concluded by saying he is committed to seeing the process through to the end.
